We, ARC ONE AI LLC (“Arcone”, “we”, “us”, “Company”), provide an artificial intelligence platform and applications for banking and utilities, together with related professional services (the “Platform”).

We respect data privacy rights and are committed to protecting Personal Data. This privacy statement (“Privacy Statement”) explains Arcone’s role as a data processor when it processes Personal Data on behalf of its Customers.

IF YOU ARE ACCESSING THE PLATFORM ON BEHALF OF A THIRD PARTY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH THIRD PARTY TO THE TERMS AND CONDITIONS OF THIS PRIVACY STATEMENT AND, IN SUCH AN EVENT YOUR USE OF THE PLATFORM SHALL REFER TO USE BY SUCH THIRD PARTY. IF YOU DO NOT HAVE SUCH AUTHORITY (TO PROVIDE ANY PERSONAL DATA OF A THIRD PARTY) OR DO NOT AGREE TO THE TERMS OF THIS PRIVACY STATEMENT, THEN YOU SHOULD REFRAIN FROM USING THE PLATFORM.

1. For the purpose of this Privacy Statement:

a. “Customer” shall mean an entity which subscribes to the Platform.

b. “Personal Data” means any information/ data that relates to an identified or identifiable natural person.

c. “User” shall mean an individual who uses the Platform on behalf of the Customer.

2. This Privacy Statement concerns the Personal Data of Users collected by the Customer and such collection may be facilitated by us.

3. Customer as data controller: If you are a User of the Platform and your Personal Data was shared with us by the Customer, the Customer acts in the capacity of data controller and has complete control over the Personal Data of the User, and Arcone acts in the capacity of data processor and only processes Personal Data on the Customer’s behalf.

4. In such an event, the privacy notice of the Customer, on whose behalf we collect and process the Personal Data, will apply.

5. This means that any inquiry, request, objection or complaint that you as a User may have in connection with the collection and/or processing of Personal Data that forms part of your platform usage should be addressed to and resolved by the Customer.
